Final paycheck late in West Virginia: what to do

Federal law doesn't require an employer to give you your last paycheck right away, but many states do, and the deadline often depends on whether you quit or were fired. Some states add penalties for late final pay. If the deadline or the next regular payday has passed, you can file a free wage claim.

This plan is general legal information, not legal advice. RobinClaim is not a law firm. Laws and deadlines change and have exceptions: check with the official source or a lawyer or legal aid office about your own case.

Your plan for West Virginia

Do now

  1. Check your state's final paycheck deadline on wageclaimmap.com for how your job ended.

Why: Deadlines range from immediately to the next regular payday, depending on the state.

  2. If you answered “I was fired or laid off” to “How did the job end?”

Use your state's rule for being fired or laid off. In some states the final pay is due right away or within a day or two.

Why: The deadline after a firing or layoff is often shorter than after quitting.

  3. If you answered “I quit” to “How did the job end?”

Use your state's rule for quitting. In some states the deadline depends on whether you gave notice and how much, so check the exact wording on your state page.

Why: For example, California pays on your last day if you gave at least 72 hours' notice, and within 72 hours if you didn't (Cal. Labor Code 202).

  4. Write down your last day, your pay rate, the hours in your last pay period, and your usual payday.

Why: You need these numbers to show what is owed and when it was due.

  5. Ask in writing (email or text) for your final paycheck, and say where to mail it or deposit it.

Why: It creates a record of when you asked, and removes any excuse about where to send it.

This week

  1. If you answered “Yes” to “Did you have unused vacation or PTO?”

Look up whether your state requires payout of unused vacation, and read your employer's written vacation policy.

Why: Some states treat earned vacation as wages that must be paid at the end; others leave it to company policy.

  2. If you're told the check is held until you return keys, a uniform or equipment, return them and keep proof, and ask your state agency whether holding pay is allowed.

Why: Many states limit deductions and holding back pay; the rules differ.

  3. If the deadline has passed, file a free wage claim with your state labor agency. If your state has no agency that takes claims, contact the US Department of Labor's Wage and Hour Division (1-866-487-9243).

Why: The agency can order payment, and in some states add penalties.

If it's not resolved

  1. Follow up with the agency and go to any hearing it schedules, with your records.

Why: Agencies decide based on records and testimony.

  2. Small claims court is another option if the amount fits your state's limit.

Why: Some workers choose court if the agency is slow.
